These Terms and Conditions govern your access to and use of the Mijay Cab mobile application and related ride-hailing services. By creating an account, requesting a ride, accepting a trip, or otherwise using Mijay Cab, you agree to these terms.

Accounts

You must provide accurate account information and keep your contact details up to date. You are responsible for activity under your account and for keeping your login credentials and device secure. Mijay Cab may suspend or restrict accounts where required for safety, compliance, fraud prevention, non-payment, misuse, or breach of these terms.

Rider Services

Riders may request trips through the app, view available ride options, receive driver and vehicle details, track trip progress, and pay applicable fares, fees, tolls, cancellation charges, or other amounts shown in the app. Riders must be ready at the pickup point, treat drivers and vehicles respectfully, and comply with applicable laws during each trip.

Driver Services

Drivers must provide accurate identity, licence, vehicle, insurance, compliance, and payment information where requested. Drivers are responsible for maintaining legal authorisation to provide transport services, keeping vehicles roadworthy, following traffic and safety laws, and providing trips in a professional manner. Mijay Cab may review, approve, reject, suspend, or deactivate driver access for safety, compliance, fraud, document, rating, or service-quality reasons.

Location, Safety, and Communications

Mijay Cab uses location information to match riders and drivers, support navigation, show pickup and arrival information, track active trips, improve safety, and resolve support issues. Service messages, trip alerts, OTPs, payment notices, and account notices may be sent by SMS, push notification, email, or in-app messages.

Payments, Cancellations, and Wallets

Fares and charges may vary based on ride type, distance, time, demand, route, region, discounts, wallet activity, or other applicable pricing rules. Payments may be processed through supported payment providers, including M-Pesa or other available methods. Cancellation fees, refunds, reversals, wallet credits, or adjustments may be applied according to the app rules and applicable law.

Acceptable Use

You must not use Mijay Cab for unlawful, unsafe, fraudulent, abusive, or harmful activity. You must not interfere with the app, misuse another person's account, provide false information, attempt unauthorised access, manipulate pricing or location systems, harass another user, or use the service in a way that endangers riders, drivers, the public, or Mijay Cab operations.

Privacy

Our collection and use of personal information is described in the Privacy Policy. By using Mijay Cab, you acknowledge that trip, account, device, payment, support, and location information may be processed as described there.

Service Availability

Mijay Cab may update, suspend, limit, or discontinue parts of the service at any time. We do not guarantee that the app, rides, drivers, payment systems, network connections, or third-party services will always be available, uninterrupted, accurate, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Mijay Cab is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by events outside our reasonable control, third-party services, user conduct, network issues, device issues, or inaccurate information provided by users.

Changes to These Terms

We may update these Terms and Conditions from time to time. We will post the updated version on this page and update the effective date. Continued use of Mijay Cab after changes take effect means you accept the updated terms.
